Article 1 — Purpose and Acceptance

These Terms of Use (TOU) govern access to and use of the Foot Exchange platform, available through the mobile application (iOS & Android) and the website www.foot-exchange.com.

By creating an account or accessing the platform, the user unreservedly accepts these Terms. If you do not accept these terms, you must not use the platform.

Foot Exchange is a B2B platform dedicated to football professionals: licensed FIFA agents, accredited clubs, sporting directors, recruiters, scouts, and professional players.

Article 3 — Access to the Platform

3.1 Access conditions

Access to Foot Exchange is reserved for professionals in the football sector.
To create an account, the user must:

Be of legal age (18 years or older)
Have a verifiable professional status (FIFA license, club accreditation, professional player status)
Provide accurate and up-to-date information during registration
Accept these Terms of Use

3.2 Account creation

Registration requires a valid email address, a secure password, and professional supporting documents depending on the selected profile type. Foot Exchange manually reviews each application within 24 to 48 business hours.

3.3 Account security

The user is solely responsible for keeping their credentials confidential. Any unauthorized access must be reported immediately to security@foot-exchange.com.

Article 4 — Description of Services

Foot Exchange provides the following services depending on the subscription plan chosen:

Article 5 — User Obligations

The user agrees to:

Provide accurate, truthful, and up-to-date information
Not impersonate a third party or create a fraudulent profile
Comply with FIFA regulations and applicable laws regarding transfers and sports intermediation
Not use the platform for unlawful, fraudulent, or otherwise non-compliant purposes
Not attempt to hack, decompile, or bypass the platform’s security systems
Not publish unlawful, offensive, discriminatory content, or content infringing third-party rights
Respect the confidentiality of exchanges and not disclose confidential information shared on the platform

Article 6 — Intellectual Property

All elements of the Foot Exchange platform (logo, design, code, texts, features, database) are protected by intellectual property laws and are the exclusive property of Foot Exchange SAS.

Any reproduction, representation, modification, or exploitation without prior written authorization is strictly prohibited.

Article 7 — Personal Data Protection

Foot Exchange collects and processes personal data in accordance with the General Data Protection Regulation (GDPR). For more details, please refer to our Privacy Policy.

Article 8 — Liability

Foot Exchange endeavors to keep the platform accessible and operational. However, Foot Exchange shall not be held liable in the event of:

Temporary service interruption for maintenance
Data loss caused by an external event (force majeure, cyberattack)
Damage resulting from misuse of the platform by a third party
Inaccurate information provided by users

Mandates generated through the platform are provided as drafting assistance. Foot Exchange cannot be held responsible for the legal consequences of a mandate incorrectly completed by the user. It is recommended to have any document reviewed by a qualified legal advisor.

Article 9 — Suspension and Termination

Foot Exchange reserves the right to suspend or delete any account in the event of:

Violation of these Terms of Use
Providing false information during registration
Fraudulent behavior or behavior contrary to professional ethics
Non-payment of the subscription (after an unsuccessful reminder)

The user may also terminate their account at any time from the application settings or by contacting support@foot-exchange.com.

Article 10 — Governing Law and Disputes

These Terms of Use are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution. Failing that, the dispute shall be submitted to the exclusive jurisdiction of the courts of Paris.

Article 11 — Changes to the Terms

Foot Exchange reserves the right to modify these Terms at any time. Users will be informed by email and/or in-app notification at least 30 days before the changes take effect. Continued use of the platform after that date constitutes acceptance of the new terms.
